Mazibuko filed the synopsis of his evidence for the claim.
He stated that between June and July 2014, he bought several varieties of 1-litre boxes of fruit juice from the supermarket in the city centre and during that period, he consumed part of the drie said on July 27, 2014, he noticed that the juice was contaminated.
“The plaintiff will state that as he was drinking the juice, he felt a soft, slimy substance in his mouth which was stuck in the opening of the container,” he submitted.
Mazibuko stated that he later went to the kitchen and poured out all the content and he was disgusted when the item, which looked like a decomposed skin of a mammal, came out.
He said he was shocked, traumatised and nauseated at the sight of the substance.
The city lawyer said the discovery injured his feelings and he suffered nausea, psychological trauma, mental anguish and loss of expectation of life up to date.
“The plaintiff will state that he suffered physical pain and discomfort in that his stomach was immediately upset the whole night, forcing him to see a doctor the next day,” his evidence read in part.
He said he was given medication, which included some anti-biotics, and he missed his July 28 karate seminar in Harare because of the problem.
Mazibuko submitted that the trauma he suffered almost ruined his karate grading examination.
He said supermarket officials initially promised to look into the matter, adding that letters of demand were sent to the defendant and the latter could not accept liability, leading him to file summons.
